By purchasing or otherwise obtaining a raffle ticket for the Defenders of Freedom Oklahoma firearm raffle (hereinafter “the Raffle”), each participant (hereinafter “the Participant”) expressly acknowledges, agrees, and warrants the following terms, which are fully legally binding and intended to minimize any ambiguity:
1. Full Legal Compliance by Participant: The Participant affirms that they are of legal age to own a firearm in their jurisdiction (e.g., at least 18 or 21 years of age as required by state law). The Participant is solely responsible for ensuring full compliance with all applicable local, state, and federal laws governing the ownership, possession, transfer, and use of the firearm in the jurisdiction in which they reside.
2. Participant’s Sole Responsibility for Legal Verification: The Participant understands and agrees that Defenders of Freedom Oklahoma does not conduct any background checks, age verification, or legal vetting of raffle participants. The responsibility to verify legal eligibility rests entirely with the Participant.
3. No Duty of Care or Oversight by the Organization: Defenders of Freedom Oklahoma explicitly disclaims any duty of care or responsibility to verify the eligibility of any Participant. The organization’s role is limited to issuing the disclaimer and conducting the raffle. No part of this disclaimer shall be construed to impose any verification obligation on the organization.
4. Absolute Indemnity and Liability Waiver: The Participant expressly agrees to indemnify, defend, and hold harmless Defenders of Freedom Oklahoma from any and all claims, liabilities, or legal actions arising from the use, misuse, or transfer of the firearm. This includes any incidents of unlawful or malicious use by the Participant or any third party. The Participant waives any right to claim that the organization bears responsibility for any subsequent events.
5. Binding Nature of Terms: By participating in the Raffle, the Participant acknowledges that these terms are binding and that they have read and understood their obligations. Defenders of Freedom Oklahoma reserves the right to modify these terms as needed to ensure full legal compliance and to protect the organization against any legal claims
6. Winners will be notified, using the name, email address and phone number that the purchaser has been requested to be on ticket stub. In the event that DOFOK is unable to contact the winner it is the sole responsibility for the winning ticket holder to contact DOFOK to claim their prize. Prizes are not transferable; the person designated on the ticket must claim the prize. ALL PRIZES MUST BE CLAIMED AND TRANSFER COMPLETED WITHIN 90 DAYS OF THE SCHEDULED DATE THE TICKET IS DRAWN.
